ARTICLE III: NOMINATIONS AND ELECTIONS |
|
|
| Section 1 Election Years: Elections of all officers and delegates shall be held at a special membership meeting called for that purpose alone in an election year. Nominations and elections shall be held not less often than every three years and shall be in accordance with the appropriate provisions of the Federation Bylaws and the Labor-management Reporting and Disclosure Act (LMRDA) of 1959, as amended. |
| Section 2 Nominations: (Nominations Meeting) |
| (A) Nominations for all officers and delegates to conventions and conferences of the Federation shall be held at a special membership meeting for that purpose alone which shall be between July 20th and August 4th at a place and time to be determined by the Management Council. |
| (B) At least fifteen days prior to the nominations meeting, the Secretary-Treasurer shall mail written notice of such meeting to all members. The notice shall contain the date, time and place of the meeting and the positions subject to nomination; |
| (C) The nominations meeting shall be held as called, regardless of any quorum requirement; |
| (D) Any member in good standing present at the nominations meeting shall be entitled to nominate any eligible candidate of his/her choice. The nominee shall be present at the meeting or his/her nominator must present a written and signed statement of acceptance of nomination from such nominee; |
| (E) To be eligible for nomination, a member must have been a full member of the Local in continuous good standing for two years preceding the nominations meeting. An eligibility list will be available at the nomination meeting; |
| (F) No member shall hold - nor accept nomination for - more than one office, although she/he may additionally hold the position of - and accept nomination for - delegate or alternate delegate. |
| (G) Immediately after receipt of all nominations, the President shall appoint an Election Committee of four (4) members in good standing, and in addition thereto, four (4) tellers. The appointees must be members in good standing, none of which are candidates. The committee shall choose a Chairperson who shall supervise the work of the tellers and shall be governed by Department of Labor election procedures. The Committee shall handle all details of the election. |
| Section 3 Elections |
| (A) The election shall be held on the third (3rd) Sunday in September of an election year no sooner than forty-five days after the nominations meeting and no later than sixty days after the same. The Management Council shall determine the exact date and place of the election; |
| (B) No later than ten days after the nominations meeting the Secretary-Treasurer shall mail written notice to all members of the election. The notice shall contain the date and place of the election, the hours of opening and closing of the polls, a sample ballot, criteria for eligibility to vote in the election, and specifications for absentee voting; |
| (C) The polls shall be open for a period of not less than six hours; |
| (D) Should a candidate be unopposed for a position the candidate will be declared elected by acclamation; |
| (E) The writing in of names of persons not nominated and listed on the ballot is prohibited and shall void the entire ballot; |
| (F) Any member who resides outside the jurisdiction or will be unable to vote at the polls may request an absentee ballot in writing to the Secretary-Treasurer who shall deliver the request to the Chairperson of the Election Committee within twenty-four hours of the receipt. The Chairperson shall within twenty-four hours of receiving the request, mail the member a ballot, a small envelope in which to insert the ballot and a larger envelope to be addressed to the Election Committee at a post office box to be secured by the Election Committee. Only the Election Committee shall have access to the post office box. Only those absentee ballots mailed to the Election Committee in sufficient time for at least two members of the Election Committee to pick up such ballots at the post office and deliver them to the polls prior to the opening of the polls shall be counted; |
| (G) One representative for each candidate shall be permitted to be present at the counting of votes, and all ballots shall be counted by the tally system; |
| (H) A plurality of votes cast shall elect a candidate to office. Alternate delegates to conventions and conferences of the Federation shall be those candidates in sequence by vote totals; |
| (I) Newly elected officers shall be installed and assume office at the next regular membership meeting following the election; |
| (J) The Election Committee and tellers shall each be compensated for their services in an amount to be determined by the Management Council. |
| Section 4 Election Challenges: A member of the local who is entitled to vote at a local election may challenge any matter relating to the nomination and election of local officers and/or convention delegates and alternate delegates after the election by filing a challenge with Local Secretary-Treasurer within 10 days after the election. The challenge shall be in writing, setting forth the exact nature and specifications of the challenge and how the election was affected. The Management Council shall, within 15 days of receipt of a challenge, meet and decide the challenge and determine the appropriate remedial action if the challenge should be ruled valid. The Local decision shall be appeasable to the International President, in writing, within 10 days of the appellant being advised of the decision. |
